iBear Mobile Application Privacy Policy

This Privacy Policy applies to your use of all iBear mobile and desktop applications owned by iBear, LLC (“iBear”, or “we”), together with their associated websites (collectively, the “Apps”), including (but not limited to) the following:

(a) iBear Money (www.ibearmoney.com);
(b) iBear Money Pro (www.ibearmoney.com/pro);
(c) Checkbook HD (www.checkbookhd.com);
(d) Debt Down (www.debtdownapp.com);
(e) Notes HD (www.noteshd.com);
(f) Time Pro (www.gettime.pro); and
(g) Overtime Rush (www.overtimerush.com).

iBear is committed to protecting your privacy and maintaining the confidentiality and security of your personal information. We provide this Privacy Policy to make our users aware of the steps we take to ensure the security of their data when utilizing the Apps. This policy describes the types of information we collect when you use the Apps, how we use and protect that information, how long we retain it, and with whom we share it. It also explains what your rights and options are as they pertain to privacy.  By using the Apps, you consent to our collection and use of your information as described in this Privacy Policy.

NOTE: Users of the Apps are also subject to the terms of the general iBear privacy policy, which can be viewed at http://ibearsoft.com/privacy. This Privacy Policy further incorporated into and is subject to the iBear Terms of Service and End User License Agreement.

1.  Information We Collect. When you download and use the Apps, we collect the following types of information:

(a) Personally identifiable information (PII):  PII is information that personally identifies one individual from another. You voluntarily provide this information to us when you establish an account to use certain Apps. Such information includes your name, username, email address, and password. Some Apps permit you to add additional information to enhance your profile. Any information you elect to add to your profile is entirely voluntary. We use the PII we collect from and about you to enable us and to interact with you on a personal level via email or by a third party service provider as discussed in Section 3 below. Some Apps have the ability to send bug reports to iBear, which include the user’s email address and an optional description of the problem, along with some auto-generated technical information. These reports are strictly voluntary and are only sent when the user after reviewing them expressly grants permission.

(b) General Information: General Information consists of information that is anonymous in nature and does not identify you as an individual. When you utilize one of the Apps, our server automatically records certain information, which is sent by your computer or mobile device and stored in log files. This includes your computer IP address, unique mobile device identifier, browser type, ISP or carrier name, and similar data. We use this information for statistical and other internal business purposes.

(c) Usage Information: We also collect information regarding the manner in which users utilize our Apps, such as application version, device manufacturer and OS version, session start/stop time, language used, launch time, selected theme, Apple watch start, new transactions, and other statistical information. We use the Flurry Analytics tool in order to develop and analyze how users use certain of the services we provide. Flurry may use information on how you use the Apps to help us gain insights on how our users use our products. We use this information to ensure that our products continue to appeal to our users, and for a number of other purposes, including auditing, research, and analysis in order to maintain, protect and improve our apps; ensuring the technical functioning of our apps, and: developing new products. You hereby acknowledge and agree that we (and, if applicable, any Third-Party Service provider) have permission to combine your usage information with that of others in a way that does not identify you or any individual person, and to use such anonymized and aggregate data, for any purpose, including but not limited to conducting certain analytical research, performance tracking and benchmarking. We may publish summary or aggregated results from time to time, and distribute or license the anonymous, aggregate research data for any purpose, including but not limited to helping to improve products and services, assisting in troubleshooting and technical support.

(d) Application Data: Application data is data entered by you on your device. Some of the Apps may offer you the opportunity to store your data in your iCloud, Dropbox, or similar 3rd party cloud storage accounts. Note: Information stored in iCloud is treated in accordance with the Apple Privacy Policy (please visit http://www.apple.com/legal/privacy/ for more details). Information stored in Dropbox is treated in accordance with the Dropbox Privacy Policy (please visit http://www.dropbox.com/terms#privacy for more details). In addition, if you do not opt-out from Apple’s standard “Diagnostics & Usage” policy, your device will automatically send crash data whenever an App crashes, and we will also have access to your crash reports.

The Money Pro App stores certain data in the Amazon cloud service platform or in the public iCloud database if Cloud Sync (Family Cloud Sync) is activated. You can share access to your data by sharing invitation codes. The invitation codes open access to your data to the users who receive your codes. Please use secure means for sharing your invitation codes. See Section 4 to learn how we protect this information.

(e) Information for Online Banking. Certain Apps, such as Money Pro, offer enhanced online banking services via subscription, which allows to download financial account data directly from their financial institution via a third-party service provider. If you subscribe, we will automatically register you with the service provider that is compatible with your bank, and will share your bank username and password, which will be transmitted over an encrypted SSL connection. Once your identity has been verified, the Apps download your account data over the same encrypted connection. Your username and password do not pass through iBear servers at any point in time. Once a successful connection has been made, the Apps securely save your service provider credentials in the iOS Keychain (iOS versions). The Keychain is a tool that is built into the iOS operating system that provides secure, encrypted storage for sensitive information such as passwords. These details are recorded so that you are not required to enter them each time you download account data from your financial institution.

2. Access Requests & Location Tracking: Some of the Apps may request access to certain data or native applications on your device in order to provide you with one or more of the functions offered by the App. These requests may include access to calendars, reminders, contacts, photos, camera, microphone, and others. If you choose to deny any such requests, you may not be able to utilize the full range of functions offered by the App that submitted the request. Certain Apps may collect and process information about your actual location using various technologies, including IP address, GPS, and other sensors that may, for example, provide us with information on nearby devices, Wi-Fi access points, and cell towers.

(a) Why do we track your location? Certain Apps require your location information for one or more features to work.

(b) Opting Out: You can manage your location preferences and opt out of location tracking in the "My Account" section of the App, or by disabling the GPS services for the App on your mobile device.

3. How We Share information. We do not share your PII with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out or as otherwise described in this Privacy Policy.

(a) Service Providers: We share certain elements of your information (including PII) with the following service providers, depending upon the specific Apps and subscriptions you use:

(i) Amazon Web Services: We host our Apps on the Amazon Web Services platform. Information stored in the Amazon Cloud is treated in accordance with the AWS Privacy Policy

(ii) Flurry Analytics: We use the Flurry Analytics tool in order to develop and analyze how users utilize the Apps, and use this information to help ensure that the Apps continue to appeal to our users, and for a number of other purposes, including auditing, research, and analysis in order to maintain, protect and improve our Apps; ensuring the technical functioning of our Apps, and developing new products. (iii) Zendesk: We use Zendesk to interact with our users via live chat, and to process customer service requests, and certain elements of your PII (such as your name and email address), may be disclosed to Zendesk when you submit a customer service request. (iv) Online Banking: If you subscribe to our online banking service, we will share your information with one of the following service providers through which your information will be transmitted to and from your bank: Salt Edge* (www.saltedge.com) or Yodlee/Envestment (www.yodlee.com). You hereby acknowledges and explicitly consent to the fact that Salt Edge, in connection with the provision of its services, shall access, collect, use, process, adapt, store, transfer and delete your information (including without limitation your financial institution account data) in accordance with Salt Edge’s Privacy Policy.

(b) Affiliates: We have established relationships with other companies (“Affiliates”) for them to offer their products or other information through links presented in some of the Apps, and we may share some of your information with that Affiliate if you elect to click on one of those links. Note that should a link take you away from the App you are using, you will be subject to the privacy practices of the company that provided the link.

4. How We Protect Information. We understand the importance of keeping your information safe and secure. We make reasonable efforts to protect your personal information and ensure the security of our systems. We employ certain methods for protecting your data including encryption of the data stored in the Amazon cloud service platform and in the public iCloud database. Certain data may be stored unencrypted for the purpose of sending push notifications. Such data is anonymized and includes date, time, amount and type of the transaction along with a unique anonymized user identifier. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. We cannot guarantee that your information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. We cannot assume responsibility or liability for unauthorized access to our servers and systems.

5. How Long We Keep Information. We retain PII for as long as necessary to fulfill a business purpose or comply with a legal request.  We may also choose to anonymize certain of the information you provide to us so that it can no longer be attributed to you if we would like to retain it for longer periods of time.

6. International Transfer. We may transfer information that we collect about you to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. and the use and disclosure of information about you, including personal information, as described in this Policy.

7. Children under 13. Our Apps are not intended for users under the age of 13, and we do not knowingly collect any personal information from children under 13.  If we become aware that a person submitting information is under 13, we will attempt to delete the information as soon as possible.  According to our Terms of Service, all users represent that they are at least 13.

8. Changes to this Privacy Policy. We reserve the right to amend, alter, or otherwise change this Privacy Policy at our sole and absolute discretion. If we make any changes regarding the disclosure of Personal Information to third parties, we will inform all registered Users, and post notice of the new Policy.  Further use of the Apps following any such change constitutes your agreement to follow and be bound by the amended Privacy Policy.
